On the afternoon of October 9th, 2024, the Seminar “Practice Tips for Successful Project Cost Claims” was successfully held at the Legend Westlake Hotel, Ha Noi. The event attracted a large number of legal practitioners specialising in construction law, including representatives from law firms, employers, engineers, and contractors.

Through the seminar, our lawyers and experts exchanged ideas and provided the participants with valuable knowledge, and multi-layered perspectives on drafting and submitting the cost claims in construction projects in a manner that is both professional and consistent with international standards. From this seminar, the participants gained practical experience to avoid common mistakes in drafting construction cost claims.

Session 1: Prolongation Cost Claims – Vietnam Perspective, presented by Mr. Le The Hung, Managing Partner of CNC Counsel.

Session 2: Building the Claim – Prolongation Costs, presented by Mr. Andrew Oddie, Managing Director of FTI Consulting.

Session 3: Causation and Remoteness in Cost Claims – A View from Common Law, presented by Mr. Shaun Pereira, Counsel of Three Crowns.

Session 4: Overcoming procedural hurdles and Effective methods of preparing supporting documents, presented by Ms. Lynette Chew, Partner of CMS.

In Session 1, Mr. Le The Hung gave his speech on the content concerning Prolongation Cost Claims in construction and analysed this issue from the perspective of Vietnamese law. Mr. Hung also gave some demonstrations to help participants thoroughly understand the issues of Prolongation Cost Claims, which include the followings:

  • Overview of Prolongation Cost Claims;
  • The delayed events which give rise to prolongation cost claims;
  • Direct and Indirect Costs from delayed events (Labor costs, equipment, Extended Surety Costs, etc.);
  • The causation between the delayed events and their consequences.

In Session 2, Mr. Andrew Oddie – Managing Director of FTI Consulting shared his view on the key factors that help strengthen the Prolongation Cost Claim documents to ensure the successful and effective implementation of the claim. With more than 20 years of experience in resolving construction disputes at leading global consulting firms, Mr. Andrew provided   participants with insights on:

  • Key aspects of compensation for delays, including other obligations alongside direct costs, indirect costs compensation, principles of damage recovery, etc.;
  • Identification of losses in delayed projects;
  • Quantification of delay-related losses;
  • Other issues related to proving and analyzing Costs in Prolongation Claims.

In Session 3, Mr. Shaun Pereira – Counsel of Three Crowns – shared his insights on causation and remoteness in cost claims from the perspective of the common law system. He provided a detailed analysis of cost claims under construction contracts, discussed the legal doctrines applied in such claims, and offered practical insights into the issue through practical cases and experiences.

In the final session, Ms. Lynette Chew – Partner at CMS – engaged with participants on how to overcome procedural obstacles and effectively prepare supporting documentation. Notably, Ms. Chew provided a thorough analysis and clarified the key differences between Prolongation Claims and Disruption Claims.
