In July 2018, CNC was appointed by Kurihara to assist them on several legal issues having arisen pertaining to the performance of two nominated MEP Subcontracts which were first signed with Hoa Binh Construction and Real Estate Corporation and, subsequently, were signed with Prime Construction and Trading Company Limited at Holm Residences Project developed by TDS Joint Stock Company.
Situated on the edge of Thao Dien peninsula, HOLM is being developed on 2.7-hectares of land which takes full advantage of more than 200-meters of water frontage. The 29-residential villas will ultimately include 11-riverfront villas, 6-pool villas, and 12-garden villas, each with private parking garages
Other amenities, located throughout the private residence, will include two swimming pools, a clubhouse with fitness center, a landscaped waterfront parkland, a centralized back-up power system and unmatched digital security.
However, in mid-2017, the competent authorities issued an order to suspend the project, which has put Kurihara and other parties in a challenging situation, most notably with respect to the protection and maintenance of project sites for an undefined and undetermined period of time, and the ability to receive respective payments from main contractors.
CNC by far – with their extensive experience the construction industry – has helped Kurihara recognize and define the (i) the legal status of projects; (ii) the necessity of long-term planning to manage suspensions, and main contractors.
CNC has earned the trust placed in them by Kurihara regarding the Holm Residences Project, primarily for their successful management of myriad cases Kurihara has entrusted them with, including debt collection case from a Korean main contractor of a large project in District 7, Ho Chi Minh City, Vietnam.
This particular case involved legal advice on issues related to labor safety and criminal liability of a legal entity; in-house counsel; settlement of labor, salary, and social insurance issues for Kurihara’s staff; and on-the-job training courses in FIDIC Contracts for both the Hanoi office and the Ho Chi Minh City office.
