A two-day training course on 2017 FIDIC Conditions of Contracts at Dinh Tan Construction
On October 27th & 28th of 2022, CNC successfully conducted a two-day training course on 2017 FIDIC Conditions of Contracts at Dinh Tan Construction. This course provided comprehensive training on the practical use of 2017 FIDIC Conditions of Contracts to more than 20 senior staff at Dinh Tan Construction.

The engagement – to provide this training course – was required because Dinh Tan Construction was previously awarded, by an Employer, an EPC Contract based on the 2017 FIDIC Conditions of Contract for EPC/Turnkey Project. However, none of their senior staff professionals were familiar with this or any other FIDIC Contract forms.
The award of the EPC Contract involved building a very large textile and garment factory in an urban area of Binh Dinh and involved the Dinh Tan Construction’s use of the legal advice provided by CNC in July 2022 whereupon CNC advised and prepared a complete set of EPC Contracts following the 2017 FIDIC Silver Book, and assisted Dinh Tan Construction throughout the negotiation rounds until the Contract was successfully agreed upon in July 2022.
Therefore, this training course was the first time that Dinh Tan Construction organized a specialized training course for their staff as it was necessary to equip their staff – specifically – with the fundamental knowledge and practical use of the 2017 FIDIC Conditions of Contract to diligently and effectively manage the aforesaid EPC Contracts, and other potential projects that were rapidly emerging.
In all actuality, since FIDIC’s launch of the 2017 FIDIC Suite of Contracts in December 2017, very few practitioners in Vietnam have made themselves aware of the changes in FIDIC’s approach as specified, which potentially poses a risk to all project stakeholders.

During the two-day training course, participants shared their previous experiences on the various applications of FIDIC Contract forms. One of the most common misconceptions involves the type of Contract Price (e.g., lump sum contract price, remeasurement contract price, etc.). Almost all project stakeholders, depending on their positions (e.g., Employers, Engineers, or Contractors) have various techniques to achieve a beneficial advantage.
We acknowledge that the primary reasons of indifference in the application of the 2017 FIDIC Conditions of Contracts, in particular, and other FIDIC Conditions of Contracts is because none of those applications were based on a fair and reasonable FIDIC approach and were not professionally adopted throughout the world.
After the course, these issues were no longer of any concern to all participants in attendance, and they appeared to have a solid understanding of 2017 FIDIC Conditions of Contracts, including the features of each application and the selection of the most suitable FIDIC Conditions of Contracts for their unique situations.
