FIDIC 1999 Contract – The Residual Values after each seminar

It has been 20 years ever since The International Federation of Consulting Engineer (FIDIC) first introduced the series of contract including Red Book (Design provided by the Employer, Contractor build accordingly), Yellow Book (the Contractor is in charge of both design and building), Silver Book (EPC/Turnkey) and Green Book (the shortened form) to the construction industry, and Vietnam is still on her way to selectively absorbing the essence of FIDIC 1999 Contract for the proper implementation, considering the surrounding specific circumstances.

Honored to be a member of Coteccons Group, Boho fully understand the values and meanings of inviting CNC to share about the topic of “FIDIC 1999 Contract Management Ability” to the core personels of the company.

Boho is also the fourth Decorating and Furniture Contractor that CNC have worked with in 2019, beside the others, namely, AA Corporation, Lecade and Solid Interior.

– “The Art of questioning” during the bid dossier preparation process, ensure both the compliance with the instructions to bidders as well as the basis to protect the Contractor in the long run

With extensive experience and various encounters with FIDIC 1999 related complicated contracts, Mr Lê Thế Hùng could share the many circumstances that occurred in real life as well as the appropriate solutions, depending on the position and role of the project partaker

Moreover, for the sake of the discussion’s liveliness and the engagement of the participants. Participants could explore the practical problems through role playing as the Employer, Contractor and Engineer to put forward their opinions on:

– The proper way to arrange the contract documents

– The contract agreement and proof of the agreement being carried out

– The legal implications upon the award of Minutes on Inspection and Acceptance

– What are the Extra work ?

– The last timeframe for the Engineer to start Extra work

– The basis to evaluate the Extra works

– The procedure to start Extra work

– The mechanisms to determine price or appropriate unit price

By doing so, participants could eliminate the perception that “FIDIC Contracts are Employer-biased” and have more faith in FIDIC Contracts

To CNC, what remained after the discussion was not only the fun times, determination of Boho’s personel to use FIDIC Contracts but also the spreading of FIDIC principles so that parties to a contract could share the same mindset, which in turn avoid potential disagreement and thereby disputes.
