In the middle of May 2018, CNC was engaged by Eurowindow JSC to advise, negotiate for two Nominated Subcontracts with Construction JSC No.1 (COFICO) and Coteccons JSC (COTECCONS) – two general contractors of the South Vietnam, to execute the Façade Package of Development South Hoian Project invested by Development South Hoian Ltd.

Even though CNC was appointed after issuing Letter of Acceptance, with extensive experiences in construction contract CNC successfully assisted Eurowindow to reach particular advantages related to integral issues of the nominated subcontracts such as: extending time for completion, determining definitions of “pay when paid”, “back-to-back obligations”, “prior of documents”, “variation”, “advance payment” and other Eurowindow’s obligations when taking-over the project.

Throughout complicated negotiation rounds, CNC was recently successful in advising ERW to minimize risks of the nominated subcontracts by explaining complication of nominating subcontract bargain and implication arising in case the adjusted subcontracts weren’t qualified as FIDIC standard.

In the middle of 2018, throughout negotiation meetings, both Parties came to a common agreement and signed the subcontracts to enter the building stage.
