12 TOPICS ABOUT THE FIDIC CONTRACT 1999

12  Topics about the FIDIC contract 1999 will clarify some issues that FIDIC users in Vietnam are concerned about 12 topics on FIDIC contracts 1999.

This is an annual activity for the community based on the positive feedback of 10 topics of the 1999 FIDIC contract that CNC has done before.

The main objective of these 12 topics is to look at the operation odd the provisions of the 1999 FIDIC contract, based on specific situations, to make some recommendations when applied in practice.

These 12 topics about the FIDIC contract are divided into 4 main groups of issues. Consist of:

Firstly, the group of principle and fundamental issues of the 1999 FIDIC contracts includes the following topics:

Topic 1: Managing the 1999 FIDIC contract during the Covid-19 Pandemic.

Topic 2: Why is the 1999 FIDIC contract widely used in Vietnam?

Topic 3: Order of contract documents according to the 1999 FIDIC contracts.

Topic 4: Difference between FIDIC Red Book 1999 and FIDIC Pink Book 2010.

Topic 5: The role of the Letter of Award in the 1999 FIDIC Contract set.

Secondly, a group of problems often arise during the implementation of the 1999 FIDIC contract including the following topics:

Topic 6: Appointment of Designated Subcontractors.

Topic 7: Penalties and Compensation for delay damage.

Topic 8: EOT Preparation, Submission and Review/Evaluation.

Topic 9: Costs due to Procrastination.

Topic 10: Damages when the Contractor terminates the Contract with the Investor.

Thirdly, the Dispute Resolution Board will be discussed in topic 11. In this topic, CNC will spend time to clarify legal and practical issues arising when applying the provisions of the Contract. FIDIC 1999 on the Dispute Settlement Board in Vietnam. 

Finally, there are issues with the application of FIDIC 2011 contracts for subcontractors. This issue is related to the practical application of the FIDIC Red Book 1999 Contract and is of special interest to the Owner, Contractor and Subcontractor.

After, these 12 topics are performed, CNC will begin to introduce to FIDIC users in Vietnam the FIDIC 2017 Contract set.
