Introduction to the FIDIC 2017 Contract Management Course

After 17 years, the First Edition of the Construction Contract published by the International Federation of Consulting Engineers (FIDIC) (FIDIC Red Book 1999, FIDIC Yellow Book 1999, FIDIC Silver Book 1999) was revised and introduced at the FIDIC International Contract Experts Conference on the 5^th of December 2017, under the name – Second Edition of the FIDIC Construction Contract.

This revision demonstrates efforts to meet the stringent requirements of construction contract managers. However, the significant changes in the 2017 FIDIC Contract could potentially undermine users’ confidence in selecting and utilizing this Second Edition. Hence, this 2017 FIDIC Contract Management Course endeavors to provide professionals with the confidence they need to work with the FIDIC 2017 Contract whenever this Edition is chosen.

The FIDIC 2017 Contract Management Course is the next course in a series of specialized courses on the use of FIDIC Contracts.

A FIDIC 2017 Contract Management Course provides participants with opportunities to:

• Identify which 2017 FIDIC Construction Contract model is suitable for the specific characteristics of each tender package and project.
• Consider selecting and applying the 2017 FIDIC Contract model in the context of Vietnam, especially the FIDIC Red Book 2017, FIDIC Yellow Book 2017, and FIDIC Silver Book 2017.
• Understand the structure of the FIDIC 2017 Contract set.
• Prepare, draft, and execute Construction Contract documents based on the 2017 FIDIC Contract model, including Special Conditions, Contract Data, Tender/Submission Letters, etc., in a detailed, comprehensive, and scientific manner.
• Effectively, systematically, and comprehensively review Construction Contract documents.
• Negotiate important terms in each Construction Contract according to the 2017 FIDIC Contract model.
• Compare 2017 FIDIC Contract Conditions with 1999 FIDIC Contract Conditions, recognizing and acknowledging the advancements and enhancements of the 2017 FIDIC Contract Conditions edition.
• Recognize similarities and differences between the FIDIC Contract and Vietnamese law, as well as their practical applications.

The following are the FIDIC 2017 Contract Management Courses that CNC has had the privilege to implement at the client’s office, as well as directly at CNC offices in HCMC:

• November 2022: CNC successfully conducted the FIDIC 2017 Contract Management Course for Supercopr – a major renewable energy developer in Vietnam. The course was conducted in English with the participation of experts from Thailand, India, Sri Lanka, and France.
• September 23rd and 24th, 2022: CNC facilitated a FIDIC 2017 Contract Management Course for Dinh Tan Construction Joint Stock Company with the participation of over 20 key personnel. The attendance of this FIDIC 2017 Contract Management Course coincided with the client’s successful bid for a large construction project for a textile, yarn, and fiber plant in Binh Dinh. CNC was directly responsible for drafting and negotiating the contract for the client of this project.
• Soon after FIDIC introduced the Second Edition – the FIDIC 2017 Contract – Kurihara Vietnam Co., Ltd., a reputable Mechanical and Electrical company with offices in Ho Chi Minh City and Hanoi, as well as a regular client of CNC, invited CNC to facilitate a FIDIC 2017 Contract Management Course to update the staff on the new points of the FIDIC 2017 Contract regarding the FIDIC 1999 Contract Edition. The course was held for key personnel of Kurihara Vietnam, who had previously attended the FIDIC 1999 Contract Management Course conducted by CNC in 2017. This demonstrates the difference in the corporate culture of the Japanese-funded enterprise, which consistently observes changes in construction contract models worldwide, and it also attests to CNC’s capabilities and experience from a customer’s perspective.
• April 8th, 2022: Dai Dung Corp, one of the top 5 major structural contractors in Vietnam, invited CNC to conduct the FIDIC 2017 Contract Management Course and introduce participants to the knowledge and practical experience (advantages and difficulties in applying the FIDIC 2017 Contract in practice) for more than 40 trainees. The selection of the FIDIC 2017 Contract model was warmly welcomed by the trainees due to significant differences between the Design Management and Construction Department, and the Legal and Accounting Department.
• COFICO, a leading construction contractor in Vietnam that has been using FIDIC Contracts for a long time and invited CNC to provide their staff with the FIDIC 2017 Contract Management Course to apprise them on the differences and fundamental changes of the FIDIC 2017 Contract compared to the FIDIC 1999 Contract Edition previously conducted by CNC. This is also the 3rd FIDIC Contract Management Course that CNC has conducted at COFICO for their entire ecosystem.
